Welcome to Scopelux (the “Platform,” “we,” “us”). By using the Platform, you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully.

First: Important Definitions

  • Platform: The Scopelux website and all its services.

  • Seller: Any merchant or brand registered on the Platform to display and sell products.

  • Buyer: Any natural or legal person who purchases a product through the Platform.

  • Product: All goods offered for sale on the Platform by sellers.

  • Order: The purchase process carried out by the buyer for a specific product.

Second: Platform Role and Responsibility

2.1 Scopelux’s Role as an Intermediary

Scopelux is an online platform that connects sellers and buyers. We do not manufacture, store, or ship the products displayed on the Platform. Our role is limited to:

  • Providing the technical infrastructure for displaying products.

  • Facilitating the payment process between buyer and seller.

  • Providing shipping services on behalf of sellers (as outlined in the shipping policy).

  • Collecting our due commission for using the Platform.

2.2 Limitation of Liability

Under these Terms, we disclaim responsibility for:

  • The quality, accuracy, safety, or legality of any product offered by sellers.

  • The seller’s ability to fulfill the order or adhere to their return policy.

  • Any dispute arising between the seller and the buyer, while we commit to providing a mechanism for communication and dispute resolution.

We act solely as an intermediary and assume no responsibility for products sold through the Platform. The seller bears full responsibility for the products they display and sell.

Third: Seller Responsibilities

3.1 Products and Content

The seller acknowledges and commits to the following:

  • All products displayed are 100% original and are not counterfeit, stolen, or fraudulent.

  • Information provided about the product (images, descriptions, prices) is accurate, complete, and not misleading.

  • Products comply with all Saudi regulations and laws, including the Anti-Commercial Fraud Law and the Personal Data System.

  • Products do not contain any illegal, offensive, or immoral content.

3.2 Order Fulfillment

The seller commits to:

  • Processing the order within 1-2 business days from the date of receiving the notification.

  • Ensuring the quality of the product before handing it over to the shipping service.

  • Adhering to the return and exchange policy outlined on the Platform.

  • Bearing full responsibility for any damages or complaints related to the product.

3.3 Indemnification of the Platform

The seller undertakes to indemnify Scopelux for any losses, damages, or costs (including legal fees) arising from:

  • The seller’s violation of any of these Terms or applicable laws.

  • Any claim related to their products (such as commercial fraud claims, intellectual property infringement, or causing harm to the buyer).

  • Any dispute arising between the seller and the buyer.

Fourth: Buyer Responsibilities

4.1 Payment Obligation

The buyer commits to paying the full amount of the order upon completing the purchase, using one of the payment gateways available on the Platform.

4.2 Receipt and Delivery

  • The buyer receives the product from the shipping company within the specified period (1-5 business days after processing).

  • In case of a defect in the product or non-conformity with the description, the buyer has the right to submit a return request within the period specified in the return policy.

Fifth: Returns and Refunds

5.1 Return Mechanism

  • Return requests must be submitted within 7 days from the date of product receipt.

  • The product will be inspected by the Scopelux team or the seller (depending on the product type) to ensure it is in its original condition.

  • The refund will be processed after the return is accepted, excluding shipping fees, if any.

5.2 Non-Returnable Products

Returns are not accepted in the following cases:

  • Used products or those with opened original packaging (for cosmetics and perfumes).

  • Products customized based on customer request (such as custom abayas).

  • Watches and jewelry after seals have been removed or after use.

Sixth: Shipping and Delivery

  • Shipping is handled by Scopelux on behalf of sellers.

  • Delivery time ranges from 1 to 5 business days after the order is processed by the seller.

  • If your order is delayed beyond the specified timeframe, The support team is committed to communicating with the customer and providing continuous updates.

Seventh: Intellectual Property

  • All content on the Platform (logos, texts, images) is the property of Scopelux or its licensors.

  • No part of the Platform may be copied or reused without prior written consent.

  • The seller acknowledges that they possess all necessary rights to display their products and images, and agrees to indemnify the Platform against any claim of intellectual property infringement.

Eighth: Disclaimer (The Most Important Part for Your Protection)

Since Scopelux is solely an intermediary platform, we provide our services “as is” without any express or implied warranties.

Under these Terms, and to the maximum extent permitted by Saudi law:

  1. We do not guarantee that the Platform will be available without interruption, error-free, or completely secure at all times.

  2. We assume no responsibility for the quality, safety, legality, or accuracy of any product displayed or sold through the Platform.

  3. We assume no responsibility for any dispute arising between the seller and the buyer.

  4. Our total liability for any claim arising from the use of the Platform shall not exceed the total commissions paid to us by the seller during the 12 months preceding the claim, or an amount of 500 Saudi Riyals for the buyer, whichever is less.

Ninth: Account Termination

  • Scopelux reserves the right to suspend or terminate any seller’s or buyer’s account immediately and without prior notice in the event of a violation of these Terms or any applicable laws.

  • In case of termination due to violation, any accrued earnings for the seller will be frozen for 90 days to cover any potential customer claims.

Tenth: Arbitration and Judicial System

  • These Terms shall be governed by and construed in accordance with the laws applicable in the Kingdom of Saudi Arabia.

  • Any dispute arising from these Terms or the use of the Platform shall be referred to the competent judicial committees in Jeddah, with the understanding that the user is not entitled to file a lawsuit without first attempting to settle the dispute amicably through the support team.
